Chapter 1. General Provisions

Article 1 (Purpose)

These Terms of Service ("Terms") govern the use of Fastgame AI, the AI game creation platform, and related services (the "Service") provided by LIVEMATCH CO LTD (the "Company"), and set out the rights, obligations and responsibilities of the Company and Members and other necessary matters.

Article 2 (Definitions)

The terms used in these Terms have the following meanings:

  1. "Service": the AI-based platform for creating, playing and sharing games provided by the Company, and all related services.
  2. "Member": a person who has agreed to these Terms and entered into a service agreement with the Company.
  3. "Prompt": a natural-language request a Member enters to plan, build or modify a game.
  4. "Game Sheet": the design document โ€” rules, controls, presentation and so on โ€” that a Member and the AI put together in the planning chat.
  5. "AI-Generated Game": a game built by AI from a Member's choices, Prompts and Game Sheet, and each later version of it.
  6. "Coins (FC)": in-service credits used to build and modify games, either granted for free or received from coin packs.
  7. "Studio": a Member's page for managing their games and showing their published games to others.
  8. "User Content": all content a Member enters into, creates, modifies, publishes or shares on the Service, including games, Prompts, comments and profile information.

Article 3 (Effect and Changes of These Terms)

  1. These Terms apply to all Members who wish to use the Service.
  2. The Company may change these Terms to the extent permitted by applicable law. Changes, together with their effective date and reasons, are announced in the Service at least 7 days before they take effect. Changes that are unfavorable to Members are announced at least 30 days in advance and also communicated individually, such as by the registered email address.
  3. If you don't agree to the changed Terms, you may stop using the Service and close your account. If you keep using the Service after the effective date without objecting, you are deemed to have agreed to the changed Terms.

Chapter 2. Membership and Accounts

Article 4 (Registration and Age Requirement)

  1. You register by authenticating with your Google account (OAuth) and must agree to these Terms and the Privacy Policy during sign-up.
  2. You must be at least 14 years old to register and use the Service. If use by a child under 14 is confirmed, the Company may immediately suspend or delete the account.
  3. You must provide accurate information; providing false information may lead to restrictions on your use of the Service.

Article 5 (Account Management)

  1. You must keep your account and the Google account linked to it secure, and you may not transfer or lend your account to anyone else.
  2. If you learn that your account has been compromised or used without permission, notify the Company immediately.
  3. You may ask to close your account at any time; the Company handles such requests in accordance with applicable law and the Privacy Policy.

Chapter 3. Using the Service

Article 6 (Making Games)

  1. You choose a genre (shooter, platformer, runner, action, puzzle, defense, racing, sports, clicker, casual, or free), a platform (PC or mobile portrait), a visual style and music, and then plan a Game Sheet in a chat with the AI. The planning chat is free.
  2. When you ask for a build, the AI creates a game from your Game Sheet that you can play right in your browser.
  3. You can ask for changes by chatting; each accepted change is saved as a new version. You can switch between versions and ask the AI to fix errors it detects.
  4. You manage your games in your Studio.

Article 7 (Publishing, Sharing and Community)

  1. You can publish a specific version of a game or make it private again, and you can share published games by link.
  2. Published games may appear throughout the Service โ€” in Explore, on the home page and in your Studio โ€” where other Members can play them and use community features such as likes, favorites, comments and leaderboards.
  3. Activity such as plays and likes may be reflected in popular games, Top Creators, creator profiles and badges.
  4. If you believe another Member's game or comment violates these Terms, you can report it using the in-Service report feature.

Article 8 (Changes to and Interruption of the Service)

  1. The Company may change or discontinue all or part of the Service as needed to improve or operate it. Significant changes or discontinuation will be announced in advance.
  2. The Company may temporarily suspend the Service for system maintenance, equipment failure, force majeure or similar reasons. Planned interruptions are announced in advance; emergency interruptions may be announced afterwards.

Chapter 4. Coins

Article 9 (Receiving and Spending Coins)

  1. Coins are credits used only within the Service. You may hold free Coins (a welcome bonus, daily and weekly recharges, and event rewards or gifts) and Coins received from coin packs ("Purchased Coins"). Some free Coins are credited only when you claim them.
  2. Playing games does not cost Coins.
  3. Coins are deducted when a build or modification request is accepted. Free Coins are used first, then Purchased Coins for any shortfall. The Coins required are shown in the Service before you make the request.
  4. If a build fails or is canceled, or a modification produces no change, the deducted Coins are returned automatically, in the same mix of free and Purchased Coins.

Article 10 (Nature of Coins and Changes)

  1. Coins have no cash value and cannot be transferred, resold or exchanged for money, except that Purchased Coins can be refunded under the Refund Policy. Free Coins cannot be refunded for money.
  2. Rewards that are not claimed, or whose validity period has passed, may lapse.
  3. The Company may change its Coin policy, including the amounts granted and the Coins required to build or modify, with prior notice.
  4. Coins obtained by improper means may be withdrawn.

Article 11 (Paid Services)

  1. The Company sells coin packs as one-time purchases; there are no subscriptions or automatic renewals. The price (including applicable taxes) and the Coins of each pack are shown on the Coins page before you buy.
  2. Our order process is conducted by our online reseller FastSpring, who is the Merchant of Record for all our orders. FastSpring handles payment, billing-related customer service and refunds, and its terms of sale also apply to your purchase.
  3. If you are under the age of majority where you live, you need the consent of a parent or legal guardian to buy a coin pack. A purchase made by a minor without that consent may be canceled by the minor or the parent or guardian, as provided by applicable law.
  4. Purchased Coins are added to your account once the payment is confirmed. Cancellations and refunds follow the Refund Policy.
  5. Before paid sales open, coin packs may be shown with a beta notice and cannot be bought. Coins granted as a free trial during the beta are free Coins and are not refundable for money.

Chapter 5. Content and Rights

Article 12 (Rights to AI-Generated Games)

  1. You retain the rights to the Prompts and ideas you enter.
  2. You hold a non-exclusive license to use your AI-Generated Games within the Service.
  3. The underlying technology, libraries and runtime environment that run the games, and the source code of the Service, are the Company's assets.

Article 13 (Platform Conditions)

  1. AI-Generated Games run only inside the Service's protected runtime environment. The Company does not provide access to, or downloads or exports of, game source code or the Service's internal structure.
  2. You may not copy or distribute AI-Generated Games outside the Service or use them commercially; violations may lead to restrictions. Promoting your game with the share links the Service provides is allowed.

Article 14 (Content License)

  1. You permit the Company to store, reproduce, display and transmit User Content to the extent necessary to provide and operate the Service.
  2. You permit the Company to feature your published games within the Service โ€” for example in galleries, recommendations and on the home page โ€” and to use them to promote and market the Service. Once you make a game private or delete it, new exposure stops.
  3. The Company may analyze Service usage data and User Content to improve the Service; in doing so it processes the data so that individuals cannot be identified, as described in the Privacy Policy.
  4. You are responsible for making sure your content does not infringe the intellectual property or other rights of others.

Article 15 (Transitional Provision for Previously Uploaded Games)

The feature for uploading HTML games made outside the Service is no longer offered. Games uploaded while that feature was available remain governed by the previous Terms: the Member who uploaded them holds the rights, and the Company holds a non-exclusive right to host and display them within the Service. The uploading Member remains legally responsible for such games and may delete them at any time.

Chapter 6. Prohibited Conduct and Reporting

Article 16 (Prohibited Conduct)

You may not do any of the following, or ask the AI to produce results that would:

  1. Create or publish illegal content, content that sexualizes children or minors, or obscene or excessively violent content;
  2. Engage in hate speech, harassment, discrimination or other conduct that harms others;
  3. Create or spread malicious code, or attempt to bypass the Service's protected runtime environment or usage limits;
  4. Infringe others' intellectual property, such as copyrights or trademarks, or their portrait rights;
  5. Impersonate another person or the Company, or repeatedly post spam or advertising;
  6. Abuse the Coin or reward system, for example by creating multiple accounts or using automation tools;
  7. Scrape the Service without permission, or reverse engineer or decompile it;
  8. Otherwise violate applicable law or these Terms.

Article 17 (Reports and Actions)

  1. When the Company receives a report or becomes aware of a violation, it may take necessary actions under applicable law and these Terms, such as making a game private, restricting posting or deleting content.
  2. The Company reviews whether reports are justified, and unjustified reports are not counted toward a Member's violation history.

Article 18 (Infringement Notices)

If you believe User Content infringes your rights, please send the details and supporting information to support@livematchgames.com. The Company will handle the notice in accordance with applicable law and let you know the outcome.

Article 19 (Third-Party Links)

The Service may contain links to third-party websites or content. Once you follow such a link, that third party's terms and policies apply, and the Company is not responsible for the privacy practices, security or availability of third-party services.

Chapter 7. Restrictions and Account Termination

Article 20 (Restrictions on Use)

The Company may restrict your use of the Service if you violate these Terms, use the Service for illegal purposes, interfere with other Members' use, provide false information, or obtain benefits by improper means.

Article 21 (Suspension and Termination)

  1. When a reason under Article 20 arises, the Company may suspend the account after notice; for serious violations, it may suspend the account immediately.
  2. Depending on the severity and nature of the violation, some or all benefits, such as Coins (including Purchased Coins) and rewards, may be forfeited.
  3. If violations by the same Member are repeatedly confirmed through justified reports, the Company may terminate the service agreement.
  4. You may object to a restriction by writing to support@livematchgames.com; the Company will review the objection and inform you of the result.

Chapter 8. Responsibilities and Disclaimers

Article 22 (Obligations of the Company and Members)

  1. The Company strives to provide the Service reliably and to protect Members' personal information.
  2. Members must comply with these Terms and applicable law, must not infringe others' rights, and must keep their account information secure.

Article 23 (Disclaimer for AI-Generated Content)

  1. Because AI-Generated Games and planning results are produced automatically, they may be inaccurate or different from what you expected, may contain errors, and may resemble other games. The Company does not guarantee that AI-generated output is complete, accurate or error-free.
  2. Review the content and quality of your game before publishing it, and use it at your own responsibility.

Article 24 (Damages)

The Company is liable, as required by applicable law, for damages it causes to Members through intentional misconduct or gross negligence. For damages caused by ordinary negligence, the Company's liability is limited to the extent permitted by applicable law, and for paid services it is limited to the fees the Member paid.

Chapter 9. Privacy

Article 25 (Protection of Personal Information)

The Company protects Members' personal information in accordance with applicable law. Details are set out in the Privacy Policy.

Chapter 10. Miscellaneous

Article 26 (Governing Law and Jurisdiction)

Disputes relating to these Terms and the use of the Service are handled in accordance with applicable law. Governing law and jurisdiction are determined first by the laws of the Member's region of residence, and otherwise by the laws of the Republic of Korea and the court having jurisdiction over the Company's location.

Article 27 (Dispute Resolution)

If a dispute arises, the parties will first notify each other in writing (including by email) and try in good faith to resolve it within a reasonable period. If it remains unresolved, either party may bring it before the competent court or, if both agree, to arbitration. During this process, the Company may take interim steps needed to protect Members and the stability of the Service.

Article 28 (Notices)

The Company may notify Members by email, in-Service notifications, website announcements or other appropriate means. Members must keep their registered contact information up to date.
